Yesterday, this Atlantic County supervisor was systematically taking down Trump and Van Drew campaign signs that were displayed in front of these homes in Egg Harbor Township, NJ.
When homeowners confronted her, she told them the signs were being removed “to mow the grass”. However, it was obvious that no grass along this road needed to be mowed. Also, no road crews in this area were out mowing grass. When homeowners telephoned Atlantic County’s roads department, they were told that the signs were in the County’s “50-foot right-of-way”.
However, a “right of way” is NOT ownership! According to Black’s Law Dictionary, the homeowners own that land by the road, subject only to the County’s right to provide safe “public passage” over the road. The county can certainly cut grass and trees that obstruct access to the road. It can remove signs near intersections that obstruct vision. The County can use the right-of-way when removing snow from the road. But did these Republican campaign signs interfere with public use of the road in any way? Did they disrupt traffic any more than the mailboxes along the road? Those mailboxes were also in the “right-of-way”, and none of them were removed! How did removal of these political campaign signs promote the safe passage of traffic over these roads? Why were these signs removed in the middle of early voting, one week before final Election Day! Isn’t that when campaign signs are most needed and most effective?
It appears that only signs supporting Republican candidate for President Donald Trump and Republican Congressman Jeff Van Drew were removed. Atlantic County is run by Republican County Executive Dennis Levinson, and a lopsided Republican majority on the Board of County Commissioners (formerly freeholders).
Did these Republican County officials order the removal of these signs? Did this Atlantic County employee do it on her own? Did any labor union of county employees order this? Did Governor Murphy or anyone from the NJ State highway department order this?
